Terms of use

This is a convenience translation. Only the German version is legally binding.

1. Scope and provider

These terms govern the use of the “Lenkki” platform (the “service”), operated by Dennis Michalski, c/o Online-Impressum.de #5482, Europaring 90, 53757 Sankt Augustin, Germany (the “provider”). The service is in beta and is currently offered free of charge.

2. Description of the service

The service allows uploading and analysing GPX routes, generating route suggestions, viewing route-related media and uploading your own photos and videos. Map data, routing and way attributes come from open data sources (in particular OpenStreetMap) and from third-party services; there is no entitlement to availability, completeness or accuracy. Some functions are not yet available to all users during the beta; this currently applies to video upload.

3. Minimum age

The service is aimed at people aged 16 and over. Younger users may only use the service with the consent of a parent or guardian; this applies in particular to creating an account, uploading media and publishing tours.

4. User account

The service can be used without an account; routes are then referenced only locally in the user’s browser. An account is created by signing in through a third-party provider. Users are responsible for the security of their third-party account. The account can be deleted at any time in the profile settings.

5. User-generated content and grant of rights

By uploading content (routes, photos, videos), the user grants the provider a non-exclusive, territorially unrestricted right, limited to the duration for which the service is provided, to store the content within the service, to process it technically (e.g. conversion into still images, anonymisation of faces and licence plates) and — for public media — to display it to other users along the same ways. The user is aware that this display to other users requires them to submit the medium for publication explicitly; without that decision it stays visible to them alone. Once submitted, the medium will also appear on other users’ tours that run along the same route. The submission can be withdrawn at any time.

The user warrants that they

  • hold the necessary rights to the uploaded content,
  • do not infringe any third-party rights (in particular copyright and personality rights) and
  • do not upload unlawful, offensive or youth-endangering content.

The provider may remove content that violates these terms or applicable law. If a third party brings a claim against the provider because of content uploaded by the user, the user shall indemnify the provider against those claims and the necessary costs of legal defence, to the extent the user is responsible for the infringement.

6. Anonymisation of uploaded media

Photos and the images generated from videos pass through automatic blurring of faces and — depending on the method in use — licence plates before publication. This process follows the state of the art but is not free of error: complete detection is expressly not warranted. It does not replace the user’s obligation under section 5 to upload only material to which they hold the necessary rights. Before a video is converted into still images, the user can hide sections; hidden sections are not converted. After release, further editing is only possible in a restricting direction, that is by removing further images or sections.

7. Publishing your own tours

Tours are private by default. If the user publishes a tour, it is listed publicly, opened up to search engines and shown with their display name as the author. The user warrants that no third-party rights preclude publication and is aware that a route can allow conclusions to be drawn about places they frequent. The provider may set published tours back to private without prior notice if they violate these terms or applicable law. Publication can be withdrawn at any time.

8. Reports, complaints and moderation

Anyone can report unlawful or infringing content — via the ⚑ button on the image concerned or informally to the point of contact named in the legal notice. The provider reviews every report and removes or blocks the content complained of as soon as the complaint proves justified. Anyone who recognises themselves in an image can demand its removal without proving that they are the person concerned. If a user considers the removal of their own content unjustified, they can object to the measure at the same address; the provider reviews the objection and restores the content if the complaint does not hold.

9. Prohibited use

Prohibited in particular are automated bulk retrieval of the service, circumventing the request limits, measures that place an excessive load on operations or on the open services used by the provider (routing, map data, place search), and any attempt to retrieve media of other users that has not been released. In the event of violations the provider may restrict access, block the account and remove the content concerned.

10. Routes and safety — important notice

Generated routes, surface analyses, hazard warnings and ratings are calculated automatically from third-party data and may be incorrect, outdated or incomplete. They replace neither your own tour planning nor compliance with road traffic regulations, local closures, weather conditions and your own ability. Use of the routes is at your own risk.

The same applies to every picture shown in the route film — to street-level imagery from external sources as well as to other users’ photos and the stills extracted from their videos. They show the state at the time they were taken, are neither maintained nor checked for currency, and are no evidence of the current condition, rideability or accessibility of a path. Years may lie between capture and display; roadworks, closures, newly installed barriers, changed surfaces as well as weather and season are not reflected in them. Where a capture or upload date is available to us, we show it on the picture concerned.

11. Map data and licences

The geometry of calculated routes is based on data from OpenStreetMap and is licensed under the Open Database License (ODbL). Anyone redistributing or publishing an exported route must comply with the licence terms — in particular the notice “© OpenStreetMap contributors”. The maps and street-level imagery shown in the service come from the providers named in the legal notice and are subject to their licences.

12. Availability

The service is provided without any assurance of a particular availability (beta). Maintenance, changes or the discontinuation of individual features are reserved. Users can export their routes as GPX at any time.

13. Liability

The provider is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In the event of slightly negligent breach of material contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for this type of contract; otherwise liability for slight negligence is excluded. Liability under the German Product Liability Act remains unaffected. For the free beta, the statutory privilege for gifts applies in addition.

14. Changes to these terms

The provider may change these terms with effect for the future insofar as this is reasonable for the user. Users will be informed of material changes within the service.

15. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers this applies only insofar as it does not deprive them of the protection of mandatory provisions of their country of residence. The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
